Who Will Attend the Meeting of Creditors?

At this meeting, you and your bankruptcy attorney will meet with the bankruptcy trustee who is overseeing your case.  Your creditors will also be invited to the meeting.

Interestingly enough, creditors rarely attend the Meeting of Creditors.

What is the Dress Code for the Meeting of Creditors (341)?

Dress is business casual.

Where is the Meeting of Creditors (341) Held?

You will receive a notice from the court (and from our office) telling you the date, time, and location of your Meeting of Creditors.

How Long is the Meeting of Creditors (341)?

The meeting is usually fairly short and the trustees often have 40 – 80 cases per day.  The average Meeting of the Creditors lasts around five to ten minutes.

What Should I Bring to a Meeting of Creditors (341)?

What Happens at the Meeting of Creditors (341)?

  • During the meeting, you will be sworn in and the meeting will be recorded– that is, it will be on the record.
  • You will need to speak clearly for the recording.
  • You will have to show a photo, state-issued ID and your social security card. If you don’t have these with you, your meeting cannot proceed and your bankruptcy discharge will be greatly delayed.
  • The trustee will ask you questions directly.   Your attorney will be there and will bring your supporting documents, but generally your attorney may not answer on your behalf.  Your attorney can object if a trustee’s question is unclear or inappropriate.
  • The trustee may also have questions for the attorney, and the attorney will answer these questions.
  • If your creditors attend the meeting (which is unlikely), they will have a chance to ask you questions about your bankruptcy petition and finances.
