Bankruptcy Intake Appointment and Document Checklist

INTAKE APPOINTMENT- WHAT TO BRING

Once you have completed your free initial bankruptcy consultation, we will ask you to come into the office for an intake appointment.

During the intake appointment, we will discuss your situation in detail and put together your bankruptcy file. The intake meeting is for people who want to proceed with filing bankruptcy.

We will ask you to bring in some supporting documents and a completed bankruptcy questionnaire with you to this appointment. A list of these documents appears below.

If you decide to file bankruptcy, you will need to update these documents with our office until your case is filed.

For example, each time you receive a new pay stub, bank statement, or tax return, please send us a copy immediately.

If your file isn’t updated on a regular basis, your bankruptcy filing can be delayed.

DOCUMENTS NEEDED FOR A BANKRUPTCY INTAKE APPOINTMENT / YOUR BANKRUPTCY FILE

  • For any documents you plan to leave with our office, please bring copies with you. We are unable to accept originals for your bankruptcy file. 
  • A certificate from a pre-bankruptcy credit counseling service. We recommend www.debtoredu.com
  • Six months’ worth of  pay stubs for both filer and spouse (if married). Please bring your spouse’s paystubs even if he or she is not filing bankruptcy. Pay stubs must be updated on an ongoing basis until your case is filed.
  • Your past two years of income tax returns (both federal and state)
  • If self-employed, income statements from the past six months showing all income and expenses for the business. Income statements must be updated on an ongoing basis until your case is filed.
  • Any documents you have related to any lawsuits, tax debts, judgments, levies, garnishments, and / or liens
  • Six months’ worth of bank statements for all banking accounts. Bank statements must be updated on an ongoing basis until your case is filed.
  • A Completed Bankruptcy Questionnaire (click here for link to the questionnaire) 
  • A signed Representation Agreement (once you have decided to file)
  • If you previously submitted a bankruptcy questionnaire but your circumstances have changed (new income, expenses, assets, debts, emergency situations, etc), please update your bankruptcy questionnaire.
  • Other documents specific to your case (as requested by your attorney)
  • Please note: to ensure the safety of our network, we are unable to accept documents via external media (thumb drives, etc.)
